Pots come in different tapers - linear (or B) pots or Logarithmic (audio or A) because of how human hearing works log/audio pots give a wider range of volume that you can hear when turning the knob and so are used for volume. If you use a linear pot it still works but the ear cannot detect the changes below the hearing noise threhold and so it sounds like all the volume change happens over the last bit of the volume dial (eg 7-10 of the dial). Playing live some players prefer this so they can krank up the volume for the guitar solo with a minimal twist on the volume.
By convention tone pots are linear or B pots so it rolls off the high frequency in a linear way but again you can use log pots but the tonal change will be over a smaller part of the knob rotation.
To make a tone pot you need a capacitor as per the Seymour duncan. So a pot plus capacitor usually means it is a tone pot......
but on a volume pot on lower volumes you can lose some of the high end of the tonal spectrum so people sometimes add a treble bleed mod (this can involve a cap plus resistor or just a cap) if you google treble mod you will see the various diagrams.
The way your pot is wired doesn't fit any of the usual mods I have seen :o)
One last question are the vol & tone pots the same only the tone pot has the little green diode/ capacitor or whatever it is
thanks for that David only on thing the white wire on your drawing is going to the empty lug you show on the tone pot
The third lug on the volume pot is bent back onto the pot and soldered - you can use a wire if you prefer

I am 120% dense when it comes to wiring the picture i posted shows the main wires coming from the pickup to the tone pot not as in your diagram to the vol pot. In my photo the are a red and black wire coming from the tone pot do they just need to be conected to a vol pot and if so to which lugs and there is also a red wire comming from the jack where does that go. Please make your answer understandable to a 5yr old
